1. Acceptance of Terms

By accessing this website (lupyak.com) or entering into a project agreement with Lupyak Studio ("we", "us", or "our"), you ("Client", "you") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services or website.

2. Scope of Services

Lupyak provides senior digital product engineering and design services, including:

• Full-stack Next.js and React web application development.
• Astro.js static and Jamstack web engineering.
• Custom Webflow design, build, and CMS architecture.
• Unreal Engine 5 (UE5) game development, C++ / Blueprints systems, and optimization outsourcing.
• UI/UX design, Figma interactive prototyping, and brand identity systems.
• Technical SEO and Generative Engine Optimization (GEO).

Specific project scopes, deliverables, timelines, and payment terms are detailed in individualized written project proposals.

3. Intellectual Property & 100% Client Ownership

We believe in total client freedom:

• Full Code & Asset Transfer: Upon receipt of full payment for agreed milestones, 100% of all custom source code, design assets, Figma files, and project repositories are transferred to the Client.
• No Vendor Lock-In: We do not hold code hostage or charge proprietary licensing fees for custom work.
• Portfolio Rights: Unless explicitly prohibited under a signed Non-Disclosure Agreement (NDA), Lupyak retains the non-exclusive right to display the completed work in professional portfolios and case studies.

4. Milestones, Delivery & Revisions

Projects are executed in transparent, milestone-driven phases (e.g., Discovery ➔ Design Prototype ➔ Development Build ➔ QA & Launch).

• Standard project agreements include dedicated revision rounds during both the Design and Development phases.
• Significant scope modifications outside the agreed specification will be quoted separately before work begins.
• Typical custom website delivery timelines range between 2 to 4 weeks, contingent upon timely client feedback and asset provision.

5. Client Autonomy & Handover

For Webflow and CMS-integrated web projects, Lupyak delivers structured CMS collections and client walkthrough training. You have full authority to edit, add, or publish content independently without requiring ongoing developer retainers.

6. Unreal Engine 5 & Game Development Outsourcing

Game co-development and outsourcing contracts are delivered strictly against agreed technical milestone specifications (e.g., specific gameplay mechanics, C++ plugins, shader setups, profiling benchmarks). All code is delivered via standard version control (Git / Perforce) and tested against target engine builds.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Lupyak Studio shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the deliverables, third-party hosting failures, API deprecations, or browser updates post-launch.
